Privacy Policy

McLean A+, Inc. (collectively “we,” “us,” or “our”) makes sure to take your privacy seriously and understand the importance of protecting your personal information in regards to the Cookies&Notes application (the "App") located at __________ and the related website located at cookiesandnotes.com and its subdomains (the "Website").  The Privacy Policy (the "Policy") here details the privacy practices of the App. The policy does not apply to third party websites and/or services in relation to the App.  By using the App, the Website and/or all components and content provided through either one or both of them (the "Service"), every individual and entity that accesses the Service ("you", "user") accept the privacy practices described in the Policy and that the Policy may change at our discretion at any time.

This Privacy Policy tells you about the ways in which information and data (the "data") are collected and used, in addition to the rights of the user in regards to these information under applicable law.

Please note that this Policy applies to information that we process when you use the Service. It does not apply to any to third parties’ websites and/or services, such as third-party applications, that you may encounter when you use the Service. We encourage you to carefully familiarize yourself with privacy policies applicable to any websites and/or services operated by third parties.

Information collected

Data provided directly to us by the user, including but not limited to:

  1. Information provided by the user and email address in providing feedback about the App or submitting questions and/or comments in the "Contact Us!" section of the App and/or form attached at the footer of the Website;

  2. Your email address upon signing in, signing up, and/or subscribing or purchasing a plan listed on the App;

  3. Any data necessary to process payment for subscription purchase. Payment is facilitated and data pertaining to payment is stored by Stripe, Inc., and its terms of use and privacy policy is located on the payment checkout page.

  4. Data provided by third-party such as Google LLC when you sign up or sign in to the App with a third-party account.  We only collect the email address information provided by such third-party for the proper functioning of the App, and no other data.  What we collect, as is stated in the Policy, may change without prior notice to the user.  After such changes are made, by using the App  you acknowledge and agree to the changes made to the Policy.

  5. Any other information you choose to provide to us in the App, including but not limited to User-generated Content (see the Terms of Use for details) that may be stored on the browser of the user's device or computer with which the App is accessed and/or the Google Firebase Cloud Firestore servers to facilitate user experience;

Information Collected Automatically
 

We may collect certain information automatically when you access and/or use the Service, including IP address and location, country, referring URLs and other links that navigates the user to the Service, when the App is used such as timestamp, and how the Service is used for user experience purposes.  None of these information reveals your specific identity such as your name.

As many businesses do, we collect such information through technologies including cookies, scripts, and other similar technologies.  Cookies are a very common type of technology used by a large number of websites you visit, and they do not generally store information for identifying an individual person, but rather for instance identifying the browser used to access the website.  A website may not be able to function properly or at all without the use of cookies or other similar technologies for security reasons.  By changing the browser settings, the user is able to restrict, block the use of or delete cookies at the risk that the website may not work as originally intended.  We also use analytics and advertisement services provided by third-parties who may also use such aforementioned technologies in addition to crash logs to collect information such as browser used, links clicked, among others, to be used primarily for analytics in regards to improving the Service and serving interest-based content and advertisements on our Service as well as other sites.  Again, these information do not identify the individual person.

Purposes for Using the Information

We use the personal data you provide to us directly for the following purposes:

 

  1. To set up your account (provided you comply with the Terms of Use, including but not limited to being of legal age of 13 or older for registration and for subsequent signing in to the account.  If signing up or signing in with a third-party service such as Google LLC, you acknowledge and agree that we may use the information provided (mainly email address, we do not actively use name or any other information) by the third-party services in carrying out the signing up and signing into the App;

  2. To facilitate the proper functioning of the App, including providing existing features, maintaining and managing the App, and improving the App;

  3. To communicate with potential emails, such as marketing as applicable laws allow, password-reset link, requesting feedback;

  4. For designing, showing, and evaluating advertisements of the Service based on your interest that are displayed to you when you visit other sites;

  5. For legal and regulatory requirements, including but not limited to inspecting data in order to comply with a legal request;

  6. For enforcing the terms and policies and protecting the property or rights of the Service, App, and third-parties;

  7. For prevention of misuse of any kind and for maintenance of overall functionality as well as security of the App.

We do not sell, lease, rent or otherwise disclose the personal data relating to our users to third parties unless otherwise stated in the Policy.

We may share user information submitted directly by the user or collected automatically with third-party service providers who may require the information in order to provide their services to the Service, including:

 

  1. Cloud storage provider (Firebase Cloud Firestore database)

  2. Signing up and signing in to the App (Google accounts)

  3. Payment providers for subscription fees (Stripe)

  4. Website provider and its affiliated and/or subsidiary service providers (Wix)

  5. Analytics providers to find ways to improve the Site and App

  6. Marketing and advertisement service providers for marketing and advertising our Service in compliance with applicable laws

  7. Email (and postal when necessary) delivery providers for communicating with the user

  8. Any public authorities if legally requested and/or to protect our rights and/or rights of third parties

  9. To our subsidiaries and affiliates; or a subsequent owner, co-owner or operator of the Service and their advisors in connection with a corporate merger, consolidation, restructuring, or the sale of substantially all of our stock and/or assets, or in connection with bankruptcy proceedings, or other corporate reorganization, in accordance with this Privacy Policy

Moreover, we may disclose information to third parties in an aggregate format that does not constitute personal data and does not allow the identification of individual users.

 

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.  We may share your information with our business partners to offer you certain products, services or promotions.

 

Some of the third-party services used by the App include Google Firebase and its products (Firestore database, Analytics), Stripe payment, and Google accounts for signing up and signing in to the App.  For signing up or signing in through Google accounts, the App will have available information attributed to the user provided by Google, which are the email address, name, and profile picture.  The App will not use all this information, and will use only the necessary information for purposes mentioned in the Policy or otherwise clearly explained within the App.  The number of third-party servicers and/or what third-party services are used as well as what information is used by the Service may be updated or changed at any time.

Your Rights

Regarding any personal data collected in the App, the user has the right to:
 

  1. request and obtain information (subject to exemptions provided by the law) regarding what personal data of the user is collected in the Service by messaging to _____________________;

  2. rectify or delete any data, whether through the features in the App or notifying us by messaging to __________________;

  3. no longer receive email marketing or non-essential communication from us through a point of contact (mainly email) provided by the user collected in the Service (essential communication emails include but are not limited to resetting passwords, email verifications);

The Service is addressed for users based in the United States of America.  If you are accessing the App from another country or countries, particularly the European Union and/or the European Economic Area, you acknowledge that data may be stored outside the country or countries in which you reside where applicable.  The Service does not address or market to users outside the United States of America.  You acknowledge and agree that any use of data collected from you residing in a different country is not conducted purposely.  If you are based outside the United States of America and have questions regarding data use, please message to us at __________________.

Security

We have in place reasonable measures within the App to protect personal data submitted or collected within the App from unauthorized access, change, use, or loss by a third party not used by the Service for the facilitation of the Service.  However, we cannot guarantee the protection of data being transmitted between the user and the App.  In addition, we cannot guarantee the protection of stored data from illegal intrusions by unauthorized third parties.  You acknowledge that we do not warrant that submitted or collected personal data will be ensured protection.

Advertisement

Our App is a subscription-based service, so we do not intentionally partner with third-party advertising networks that show content regarding other products or services that are not ours and therefore, aside from and consistent with what is written in the Policy, do not serve ads on the App or Service aside from content pertaining to our own services.  We are not liable in any way for advertisements or content served to you in other websites or applications of other products and services that is not ours related to your use of our Service; consult the Terms of Use and/or Privacy Policy of the website or application in which the ad or content was seen.

Children's Privacy

By accessing and/or using the App, you represent that you are a user of the age of at least 13 years old.  The App does not knowingly collect personal data from children under 13 years old (or applicable age in your country). If we learn that data has been submitted or collected by someone under the age of 13, the account will be unsubscribed and deactivated, and any data collected will be deleted.  If there is any suspicion of data collected from or submitted by children under the age of 13 years old, please contact us at ________________.

Regarding California Consumer Privacy Act Rights

The following provides supplemental description regarding personal information and of the CCPA rights for residents of California.
 

We collect information as mentioned in the "Information Collected" and "Information Collected Automatically" sections above in the following categories:
 

  1. Identifiers, including email and IP address;

  2. Internet and/or other network activity, including browser used, links clicked;

  3. Commercial information, including payment information and purchase history

  4. Information provided by user in the App, including User-generated Content, customer service email;

  5. Any inference drawn from the other categories

Categories of sources from which we collect the information may be the following:

 

  1. The user;

  2. Third party service providers including payment servicer, analytics, advertisement platforms;

  3. Browser technologies including cookies;

 

The purpose for the use of these information as well as what information is disclosed is as addressed in "Purposes for Using the Information".

You have the right to request the disclosing of information to you in regards to the collection and use of your information for the past 12 months upon verification of your request.  Information that will be disclosed to you consist of:

  1. Categories of information collected about you;

  2. Categories of source of information collected about you;

  3. Business/commercial purpose for collecting information about you;

  4. Categories of third parties the information is shared with;

  5. Specific components of information collected about you;

  6. If your information was disclosed for business purpose, the category of information each category of recipient was disclosed to.

 

You also have the right to request deletion of any part or all of the information collected from you.  Upon verification of your request, we will delete your information, as well as have third-party service providers to delete information regarding you, within 1-2 months.  Exceptions may apply.

 

In order to exercise the aforementioned rights, you, another person you authorize to act on your behalf who is in registration with the California Secretary of State, or yourself acting on behalf of your minor child   may submit a verifiable consumer request by contacting us at __________________.  A request may be made once every six months.  In your request, please provide sufficient information along with a clear request so as to assist us in verifying you or the one you represent, of whom we have collected information and in responding to your request in a timely manner.  The response to the request will be sent via email to the email address that was used to send your request.  The response will specifically only address the previous six months leading up to the date of the sent request.  If the request cannot be fulfilled due to an exception that may apply as aforementioned, we will still send a response explaining why. Unless permitted to by the CCPA, we will not discriminate against you, in terms of price and use of the main features of the App, for exercising your CCPA rights.

Changes to the Privacy Policy

We may make changes to the Policy from time to time, and this will be made clear by the changing of the date near the bottom of the policy as well as a prominent notice in the App.  Please review the policy often to be informed of the changes made.  Once again, by accessing and/or using the App, you acknowledge and agree to what the Policy specifies.
